Motorized pleasure craft are divided into 2 categories:

Boats 10-24m
Vessels > 24 m

IDENTITY DOCUMENT AND NAUTICAL LICENSE

Both must obviously be valid and must be kept on board in the original
or certified copy.
The boat license is mandatory when the engine power exceeds 30 kW (equal to 40 HP) and
however for navigation over 6 miles.
1 mile = 1.852km
The boat license is valid for 10 years and 5 years after the age of 60.
The 3 main categories of license are:

 

  • Driving license A: (within 12 miles or without limits) command of boats and boats
  • License B: command of ships. It is possible to obtain the B license only after having been in
    possession of the driving license A for at least 3 years.
  • Driving license C: (within 12 miles or without limits) for the management of boats and boats
    issued to disabled people. There must be another adult on board
    able to perform the functions necessary for navigation.

The renewal of the license must be carried out after 10 years (5 years for those over 60 years of age) at the headquarters of the Port Authority or the Civil Vehicle Authority that issued it.
The documents to be submitted are:

  • Medical certificate with stamp duty with vision and hearing parameters issued by a public health facility (e.g. ASL)
  • Unique model provided with revenue stamp with passport photo
  • photocopy of identity card and valid tax code
  • old license to be renewed

In any case, it is advisable to inquire directly at the competent Port Authority to verify the exact list of documents necessary for the renewal of the nautical license.

Timing: about 40-50 days

DECLARATION OF ENGINE POWER

The document is issued by the manufacturer and contains the construction characteristics, the
power in Kw and Cv, engine capacity and hourly consumption.
The document must always be kept on board.
In boats, the declaration of engine power can be found in the navigation license.

INSURANCE

All pleasure craft, including tenders equipped with a marine engine, are required to have the RC policy, or Civil Liability towards third parties.

Its price varies mainly according to the horsepower of the engine and obviously in relation to the ceiling defined at contract level.
For greater protection there are body policies that cover material and direct damage they can affect boats while navigating and/or lying in the water or on land.
For accessory insurance, it is advisable to check the contractual conditions before stipulating.

REGISTRATION AND NAVIGATION LICENSE

Through the STED (Telematic System of the Yachtsman) it is possible to register boats and ships pleasure boats to the ATCN (Central Telematic Archive of Pleasure Crafts).
The owner or user of a vessel or vessel under financial leasing can ask the provisional registration of the unit.
The vessels are exempt from the obligation to register but it is possible to do so by transforming the vessel into a pleasure boat subjecting it to all the regulations foreseen for this category.
Once registered, the unit will have to display the Italian flag and will be given a registration number identification that will be applied on the right side at the bow and on the left side at the stern.
The latter is composed of the initials of the registration office followed by the number of registration and the letter “D” in the case of boats or “ND” in the case of ships.
Recreational craft can be canceled from the ATCN by:

  • Sale or transfer abroad
  • Demolition
  • Transfer from the category of boats to that of boats
  • Switching to another register
  • Actual or presumed loss

The navigation license shows: the registration number and initials, the type and the main characteristics of the hull and the engine system, the name or corporate denomination of the owner, the name of the unit, the type of navigation authorized.
In addition, the maximum number of people who can be transported, any deeds of incorporation, transfer and extinction of ownership and other real rights of enjoyment and guarantee on the unit, as well as any commercial use thereof. The license is renewed in case of modifications of the type and main characteristics of the hull, of the engine and the type of navigation authorised.

SAFETY CERTIFICATE

The document certifies that the unit complies with the directives of the safety regulation according to the type-approval category.

The safety certificate is issued by the maritime authority or by the civil motorization on the basis of a technical documentation issued by a legally recognized certifying body.

The first release takes place automatically upon registration of the vehicle; subsequent renewals must be carried out by the owner of the unit who will have to contact a certifying institute and ask that a technician be sent to him who, once he has visited the boat, will issue the new certificate.

The details of the certificate must be reported on the navigation license.

The first renewal must be carried out according to the deadlines:

  • CE category A and B units or non-CE units enabled without limits from the coast = after 8 years
  • CE category C and D units or non-CE units enabled within 6 miles of the coast = after 10 years


Subsequent renewals for each category of unit occur every 5 years. In the event that the unit has undergone serious damage or innovations have been made or has undergone changes to the non-essential technical construction characteristics, the safety certificate must be validated.

DECLARATION OF CONFORMITY – CE MARKING

The CE marking, according to EU directive 2013/53, is necessary for placing a new pleasure boat on the EU market as it certifies the minimum safety characteristics required by the directive, with particular attention to robustness, buoyancy, stability, motorization and maneuverability, as well as those of environmental protection.

For pleasure boats without CE marking, the navigation limits from the coast are:

  • Without any limit in inland waters
  • Up to 6 miles from the coast


For CE marked craft the navigation limits are determined according to the following design categories:

  • Category A: without any limit
  • Category B: with wind up to force 8 and with waves up to 4 meters high
  • Category C: with wind up to force 6 and with waves up to 2 meters high
  • Category D: in sheltered waters, with winds up to force 4 and waves up to 0.5 meters high

 

Vessels without CE marking can navigate:

  • Within 6 miles of the coast; except skates, pedalos, windsurfs which must be within 1 mile
  • Within 12 miles if approved for seagoing
  • Vessels with CE marking can navigate within the limits established by their design category.

The CE marking is printed on a special plate which shows the design category, the maximum recommended capacity and the maximum number of people that can be transported.

Vessels not marked CE pursuant to art. 60 of Ministerial Decree 146/08 without a certificate of approval can transport:

  • 3 people up to 3.50 m in length
  • 4 people from 3.51 to 4.50m
  • 5 people from 4.51 to 6.00m
  • 6 people from 6.01 to 7.50m
  • 7 people from 7.51 to 8.50m
  • 9​ people over 8.50 m​​


For the purposes of navigation safety, for boats (approved and non-approved) carrying underwater sports equipment, the number of persons transportable is reduced by one person for every 75 kg of material embarked.

RTF CERTIFICATE AND LICENSE

The Limited Certificate of Radiotelephonist or VHF license is the document that certifies the suitability for the use of the VHF, whether it is fixed or portable.

The latter is mandatory for navigation beyond 6 miles from the coast.

The document authorizes the user to use the VHF equipment on boats that do not weigh more than 150 tons and a radio station with a power that does not exceed 60 W.

In fact, to receive this certificate, it is sufficient to declare knowledge of the general practices of Radiocommunications and self-certify that one is not subject to a criminal record.

The RTF certificate, like the operating licence, is issued by the Ministry of Economic Development.

The license allows you to use the VHF device only for emergency and rescue.

For public correspondence it is necessary to rely on one of the concessionary companies to which the relative fee will have to be paid.

The license becomes invalid in the event of change of ownership/owner of the boat or replacement of the on-board equipment.

The on-board radio station may only be used by personnel in possession of a certificate corresponding to the type of device used.

Both documents  must be kept in the original or certified copy.

MANDATORY ON-BOARD EQUIPMENT

The mandatory on-board equipment is essential for safe navigation, it varies according to the distance from the coast and must always be kept in good condition and close at hand on board.

– BURNERS KIT: 1 SMOKE BOTTLE, 2 RED LIGHT HAND BURNERS (all burner kits are valid for 4 years from the date of manufacture)
– REGULATORY LIGHTS: a) for daytime navigation up to 12 miles from the coast, the lights can be replaced by a white light safety torch;
b) a motorized unit up to 7 meters long and with speeds up to 7 knots can show a white light visible all around the horizon. if possible, moreover, it must show the side lights;
c) in sailing vessels of less than 20 metres, the statutory lights may be combined in a single light fixed at the head or close to the masthead, where they can be seen more easily.
– SOUND SIGNALING EQUIPMENT OR GAS HORN: all vessels longer than 12 meters must be equipped with a whistle and bell. Warning: the bell can be replaced by a portable sound device.

– FIRE EXTINGUISHER a) Crafts must have only one fire extinguisher on board, regardless of engine power;
2) for boats, the number of fire extinguishers and their extinguishing capacity are shown in Annex V to the Regulation of the Nautical Code.
